BUTUAN CITY – The Sandiganbayan has dismissed a P5 million ill-gotten wealth case against the late President Ferdinand Marcos, Sr., and his wife, Imelda, due to the prosecution’s failure to act on the case for decades.
In a 12-page resolution, the anti-graft court cited the prosecution’s unwillingness to pursue the case since 1994, resulting in its dismissal under Civil Case 0032.
The case alleged that the Marcos couple, along with Fernando Timbol, had unlawfully acquired vehicles and household appliances that were to be returned to the government.
The Sandiganbayan stated that the prosecution’s “unexplained inaction for decades” had caused the case to remain unresolved and congested the court’s docket. As a result, the court ruled that the complaint against the Marcoses could no longer be pursued.
The anti-graft court emphasized that the delay justified the legal dismissal of the case, including claims for damages and attorney’s fees, effectively disposing of the complaint in its entirety.
